These Terms of Use (“Terms”) govern your access to and use of brian-yang.com (the “Site”), operated by Brian Yang (“Brian,” “I,” “me,” or “my”). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, do not use the Site.

1. The Site Is Informational Only

This Site is a portfolio and informational site. It is not a contract for services. Nothing on this Site — including project descriptions, results, testimonials, pricing indications, blog posts, or any communication initiated through the contact form — constitutes an offer, promise, or binding agreement to perform services. Any engagement for design or development work is subject to a separate written agreement signed by both parties.

2. Intellectual Property

All content on this Site — including the design, layout, source code, written content, project case studies, photographs of Brian Yang, and the “Brian Yang” name and wordmark — is owned by Brian Yang and protected by U.S. and international copyright, trademark, and other intellectual property laws.

Project screenshots, client logos, and case study materials are displayed for portfolio reference. Trademarks of third parties (including former and current clients) belong to their respective owners and are shown only to identify the work performed.

You may not copy, reproduce, scrape, mirror, or republish any portion of this Site without prior written permission. Limited personal, non-commercial viewing is permitted. Commercial use, rebranding, or redistribution is prohibited.

3. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Site, its servers, databases, or any related systems.
• Interfere with, disrupt, probe, or stress-test the Site or its infrastructure.
• Use any automated system (bots, crawlers, scrapers, etc.) to bulk-copy, mirror, or redistribute Site content without prior written consent. Conventional search-engine indexing, and automated agents that access the Site in accordance with its robots.txt directives, are permitted; that file is the authoritative statement of which agents may access this Site and how.
• Submit false, misleading, or harmful content through the contact form, including spam or phishing attempts.
• Reverse engineer, decompile, or attempt to extract the source code of the Site beyond what is publicly served by the browser.

4. No Warranty

PROJECT RESULTS, METRICS, OR OUTCOMES SHOWN ON THIS SITE ARE SPECIFIC TO THOSE PROJECTS AND DO NOT GUARANTEE OR PREDICT SIMILAR OUTCOMES FOR ANY OTHER ENGAGEMENT. CONTENT ON THIS SITE IS NOT LEGAL, FINANCIAL, MEDICAL, OR PROFESSIONAL ADVICE.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall Brian Yang, his agents, or his affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, business interruption, or any other commercial damages or losses, arising out of or related to your use of (or inability to use) this Site, even if advised of the possibility of such damages. Brian Yang's total aggregate liability arising out of or relating to these Terms or your use of the Site shall not exceed one hundred U.S. dollars (USD $100.00).

6. Indemnification

You agree to defend, indemnify, and hold harmless Brian Yang from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit through the Site.

7. External Links

The Site may contain links to third-party websites, including client sites, social media, and external resources. Those sites are not under Brian's control. I am not responsible for their content, privacy practices, accuracy, or availability. Linking does not imply endorsement.

8. Governing Law & Venue

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue in those courts.

9. Time Limit on Claims

Any cause of action arising out of or related to these Terms or your use of the Site must be filed within one (1) year after the cause of action accrues, or it is permanently barred.

10. Class Action Waiver

You and Brian Yang each waive the right to participate in any class action, collective action, or representative proceeding. Any dispute shall be resolved on an individual basis only.

11. Severability

If any provision of these Terms is held to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if not possible, and the remaining Terms shall remain in full force and effect.

12. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Brian Yang regarding the Site and supersede any prior agreements regarding the same subject matter.

13. Changes

I may update these Terms at any time. The “Last updated” date will reflect the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
